The services that NANSENSE Inc. provides to you are subject to the following Terms of Service relating to sales, rentals, data cleanup, updates, upgrades and the contents of this website. Please read the agreement carefully.
By accessing the website at https://www.nansense.com, NANSENSE Inc. provides you with access to a variety of resources, including product information, documentation, download areas, code repositories, software, access to hardware and developer tools (collectively known as "Services"). Services also include anything relating to sales, rentals, data cleanup, updates, upgrades and the addition of any new web contents. Services are subject to the following terms.
NANSENSE Inc. reserves the right to refuse services to anybody including but not limited to the following: if it is deemed that NANSENSE Inc. technologies and efforts may not satisfy a customer’s requirements; if the systems requested are not available or in stock; to anybody abusing NANSENSE Inc.’s Discounts Policy or any other policy or term; to anybody showcasing disruptive or abusive behavior towards NANSENSE Inc. employees, sales representatives, support agents, partners or distributors; to anybody attempting to modify or use a NANSENSE Inc. outside of its intended safe use. Refusal of Services can be without notice and, in the case of prepayments, subject to a full refund. Refusal of Services includes but is not limited to sales, system rentals, updates, upgrades, data cleanup and others. NANSENSE Inc. is not liable for damages incurred by the prospective client resulting from the Refusal of Services.
Unless otherwise specified, the Services are for your personal and non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services. If you intend to purchase a system for commercial purposes, you must also purchase a commercial license.
Any software that is made available to download from the Services ("Software") is the copyrighted work of NANSENSE Inc. or that of its suppliers. Use of the Software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the Software (known as the "License Agreement"). An end user will be unable to install any Software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms.
The Software is made available for download solely for use by end users according to the License Agreement. Any reproduction or redistribution of the Software not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
Without limiting the foregoing, copying or reproduction of the software to any other server or location for further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by NANSENSE Inc.
Permission to use Documents, such as white papers, press releases, datasheets and FAQs, from the Services is granted, provided that:
Elements that are protected by trade dress, trademark, unfair competition, and other laws and may not be copied or imitated in whole or in part. No logo, graphic, sound or image from this website may be copied or redistributed unless expressly permitted by NANSENSE Inc.
As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any NANSENSE Inc. server, or the network(s) connected to any NANSENSE Inc. server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any NANSENSE Inc. server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
You agree that you will pay for all products you purchase from NANSENSE Inc., and that NANSENSE Inc. may collect or charge your payment method for any products purchased and for any additional amounts (including any taxes and late fees, as applicable) that may be accrued by or in connection with your purchases. You are responsible for timely payment of all fees and you are responsible for providing NANSENSE Inc. with a valid payment method for payment of all fees. Transactions are final.
The materials on NANSENSE Inc.'s website are provided on an "as is" basis. NANSENSE Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, NANSENSE Inc. does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
The materials appearing on NANSENSE Inc.'s website could include technical, typographical, or photographic errors. NANSENSE Inc. does not warrant that any of the materials on its website are accurate, complete or current. NANSENSE Inc. may make changes to the materials contained on its website at any time without notice. However, NANSENSE Inc. does not make any commitment to update the materials.
In no event shall NANSENSE Inc. or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on NANSENSE Inc.'s website, even if NANSENSE Inc. or a NANSENSE Inc. authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.
By placing an order with NANSENSE Inc. either directly or through https://www.nansense.com, you agree to the following Terms of Sale in addition to the aforementioned Terms of Service.
All products offered on this site are subject to actual availability, even if the site states that a product is in stock. Data, including prices, may be inaccurately displayed on our site due to system or typographical errors. While we make every attempt to avoid these errors, they may occur. We reserve the right to correct any and all errors when they do occur, and we do not honor inaccurate or erroneous prices. If a product's listed price is lower than its actual price, we will, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. Our prices are also subject to change without notice.
You are responsible for all shipping and delivery costs and all shipping fees will include full insurance for damage and loss during shipping. For normal that are in stock, NANSENSE Inc. will use reasonable efforts to commence the shipping of your merchandise within two weeks of your order. All lead times are approximate and are not meant to be guarantees of completion or delivery dates.
Due to the bespoke nature of NANSENSE Inc. equipment, equipment purchased from NANSENSE Inc. is not refundable except in limited circumstances and at NANSENSE Inc.'s discretion. If you receive damaged equipment during shipment, such damage must be noted at time of your receipt of the merchandise. Merchandise signed for in good physical condition at time of your receipt of the merchandise is not refundable. Upon request, NANSENSE Inc. will replace your defective equipment. However, if a replacement is unavailable, NANSENSE Inc. may solely determine to provide you a refund.
Prior to returning merchandise to NANSENSE Inc., you must contact NANSENSE Inc. to obtain a refund authorization number and shipment address by emailing info@nansense.com. NANSENSE Inc. reserves the right to refuse your return if the merchandise is not in the original condition and packaging. You are solely responsible for any further damage to the returned merchandise which may occur during shipment back to NANSENSE Inc.
By placing an order, you agree that you will pay for all the products you purchase from NANSENSE Inc., and that NANSENSE Inc. may collect or charge your payment method for any products purchased and for any additional amounts, including any taxes and late fees as applicable, that may be accrued by or in connection with your purchases. You are responsible for the timely payment of all fees and for providing NANSENSE Inc. with a valid payment method for the payment for all the fees.
Unless specified, bank wire payments are required for orders. Credit card purchases may incur an additional fee. You are responsible for all wire transfer fees and credit card fees.
The following terms apply to all products:
NANSENSE Inc. warrants to the original consumer that the product is free from defects in materials and workmanship for a period of one year from the date of purchase. During the limited warranty period, and upon proof of purchase, in the form of product registration, packing slip or invoice, the product will be repaired or replaced without charge.
Repair or replacement as provided under this warranty is the exclusive remedy of the purchaser. This warranty is in lieu of all other warranties, express or implied, including any implied warranty of fitness or suitability for a particular use or purpose and NANSENSE Inc. shall in no event be liable to the purchases for indirect or consequential damages of any kind. Some states do not allow the exclusion or limitation or incidental or consequential damages or allow limitations on how long an implied warranty lasts, so the above limitations and exclusions may not apply to you.
Repair is subject to parts availability and NANSENSE Inc. having the parts in stock. Repair may be refused if the parts are not in stock or discontinued directly by NANSENSE Inc. or indirectly by a third-party vendor.
Any use of NANSENSE Inc. equipment for purposes other than those expressly promoted by NANSENSE Inc. or any disassembly, modification or attempts at backwards engineering the NANSENSE Inc. hardware or software will void this and any other warranty or return rights.
When NANSENSE Inc. receives the product, it will determine whether the product can be repaired or needs to be replaced. If the product is not covered by the warranty due to misuse, damage caused by the end user and/or is outside the warranty period, it will be subject to return shipping and/or repair fees. Non-warranty repair fees do not include any shipping charges which may be associated with shipping the product back to the end user.
NANSENSE Inc. reserves the right to refuse discounts to anybody. All discounts shall be seen as privileges awarded by NANSENSE Inc. to customers on a case-by-case basis provided that, in the case of software discounts, adequate proof is given that the customer is a member of an educational or academic institution and is using the system for non-commercial purposes only and, in the case of bulk discounts, the system is not acquired for resale purposes or to be used by an entity not explicitly listed in the purchase order. Any attempt to abuse the privilege of a discount and this Discount Policy may result in refusal of services and even cancellation of services without notice.
