1. Improper Use

The purchaser shall indemnify NANENSE Inc. from all third-party claims arising from any product use not approved by NANSENSE Inc. and reimburse NANSENSE Inc. for all costs in connection with such claims.

• NANSENSE systems are not medical devices and no medical claims are made or implied as a result of using our equipment.
• NANSENSE systems are intended for use only by healthy and able-bodied individuals over the age of thirteen. Purchaser must assume responsibility and liability for offering the system to any other demographic.
• NANSENSE systems are not fit for use in life sustaining situations. Life sustaining situations are those for which the wellbeing of the operator is dependent on the correct operation of the equipment.
• NANSENSE systems are not fit for use in security sensitive situations. Security sensitive situations are those for which a malfunction is expected to lead to bodily harm or significant property damage.
• NANSENSE systems are not fit for use in the operation of any motor vehicle on a public road.

2. Health Risks & Personal Injury

NANSENSE motion capture systems are to be worn as designed and any improper use, including failure to dress or wear the system correctly, may lead to health risks and personal injury for which NANSENSE Inc. is not liable.

• The purchaser assumes any liability for modifying the hardware or clothing. NANSENSE Inc. reserves the right to void any warranty, licensing and support if changes are made to the system or if the system is disassembled or tampered with. This includes extracting the sensors from the clothing and replacing the clothing with straps. Modifying the system incorrectly may lead to personal injury.
• The purchaser has the responsibility to ensure that the system is not damaged in any other way before use. This includes damaged clothing, connectors or cables
• The purchaser must inform the wearer of the suit of potential allergic reactions, rashes and other skin conditions that may arise from wearing the clothing.
• When washing the suit, the purchaser assumes all responsibility for allergic reactions and skin conditions that can be caused by detergents and other cleaning substances being applied to the fabric of the suit. It is important to thoroughly rinse the clothing after washing to prevent such problems
• The actor must be instructed to move with care to prevent any bodily injuries including but not limited to scrapes, scratches, bruises and others. The actor must take care to avoid falling, bumping or resting against surfaces when wearing the hardware. The actor must take care to avoid tripping over cables, straps and other trip hazards.
• To prevent fire or electric shock, the equipment must not be exposed to water, rain or moisture.
• It is important for actors to shower and wear clean clothes underneath the suit. It is also important that the suit is washed between capture sessions or actors. Health risks are possible due to improper hygiene.

3. Wireless Radio

NANSENSE systems can broadcast data wired or wirelessly. It is recommended that the systems are used in wired mode in all circumstances where radio interference may pose a risk. In those circumstances, the system may also be used autonomously using the on-board data logger. For wireless data communications, NANSENSE motion capture systems rely on the use third-party FCC approved wireless communication devices to transmit data from the hub to a computer.

• NANSENSE systems have been tested and found to comply with the limits for a Class B digital device, pursuant to part 15 of the FCC Rules. These limits are designed to provide reasonable protection against harmful interference in a residential installation.
• NANSENSE systems generate, use and can radiate radio frequency energy and may cause harmful interference to radio communications if not installed and used in accordance with the instructions.
• NANSENSE systems operation is subject to the following two conditions: (1) this device may not cause harmful interference, (2) this device must accept any interference received, including interference that may cause undesired operation.
